Child neglect, abuse or abandonment by a daycare worker is every parent’s worst nightmare. After all, these are trained employees who are paid to ensure your child’s safety and welfare. Yet every month, disturbing reports of such travesties make headlines across the nation, causing many families to take pause.
The Long Island personal injury lawyers of Edelman, Krasin & Jaye understand the heartache and anger felt by parents who’ve been betrayed by seemingly competent daycare workers. If your child has suffered harm through negligence, neglect or assault in such a facility, our team will make sure your rights are fully protected.
Kids abandoned by daycare worker in Suffolk County
A worker at Brooklyn’s Elite Christian Daycare has been charged with two counts of child endangerment and two counts of child abandonment after she abandoned two of her charges at Westfield South Shore Mall. The children, who are two and three years old, were found playing by themselves at the entrance to JC Penny’s – alone and unharmed. It is unknown why 34 year-old Nicole Noble deserted the kids at the Bay Shore mall, though her brother chalks her actions up to a “mental breakdown.” According to Suffolk County officials, Noble’s mother owns the daycare center, and left the children with her daughter while she attended to other errands. Noble has entered a plea of not guilty.
Daycare center neglect can have much grimmer consequences, as Texas parents Perry and Lauren Felton discovered in 2013. Their four-month old child was allegedly given Benadryl by staff during nap time in an effort to get the infant sleepy. The little girl never woke from her nap, as it was later determined she was given a lethal overdose of the medication. Her parents have since filed a wrongful death lawsuit against the Waco facility, called Spoiled Rotten Daycare, and its owners.
“We’re really suing to raise awareness and try to make sure this doesn’t happen to any other family,” said the plaintiffs’ attorneys.
Liability issues with daycare accidents
There’s no doubt that some daycare accidents are just that – accidents. Others, however, may have been avoided had owners, workers and helpers eliminated potential hazards, followed safety guidelines and supervised in a responsible manner. Daycare workers may be held legally accountable for child injuries or deaths that result from negligent actions, if the court finds that staff breached their duty of care.
A lawsuit filed regarding daycare injuries can attempt to recover damages for:
- The child’s medical costs
- Lost income by the parent
- Pain and suffering
- Emotional distress
