Bay Shore Motorcyclist Charged in DUI Crash That Killed Wife

drunk driverAccording to Suffolk County police, a motorcyclist’s intoxication was likely to blame in a crash which resulted in the death of his wife who was seated behind him at the time of the event. The 26-year-old Bay Shore man has since been charged with driving while intoxicated during the crash which occurred on Sunrise Highway near the Robert Moses Causeway in West Islip.

Motorcycle crash kills wife, husband faces charges

Traveling eastbound at roughly 12:30 a.m., the motorcycle driver lost control of his 2000 Kawasaki, fatally injuring his 26-year-old wife, who was transported to Good Samaritan Hospital Medical Center, where she was declared dead. The driver suffered injuries as well, though they were not classified as life-threatening. He was ultimately arrested and charge with Driving While Intoxicated, and the investigation into the facts surrounding the event remain under investigation by the Vehicular Crime Unit.

Accident highlights dangers of drunk driving

Driving while under the influence of alcohol is known for producing catastrophic consequences, including severe injury and death. An alarming number of vehicular accidents are the product of reckless drunk driving. Those who are harmed by such blatant disregard for the safety of others often wonder whether they will be able to obtain justice and accountability for the losses they have sustained.

Criminal and civil sanctions for DWI

A great deal of attention tends to be paid to the criminal penalties imposed on drunk drivers, and such sanctions can indeed be valuable deterrents. Individuals who are convicted of driving while intoxicated and causing death or serious injury may be subjected to significant fines, loss of license privileges and even incarceration. Though these measures are of critical importance, victims of drunk drivers should know that criminal penalties are not necessarily the only avenue of recourse. When the acts of a drunk driver cause a victim to suffer serious physical impairment or death, the law provides an opportunity to pursue compensation from the responsible party.

Individuals who have sustained substantial losses due to the acts of a drunk driver may decide to file suit as a means to recover civil damages that could include payment for:

  • Medical bills
  • Loss of income
  • Pain and suffering
  • Loss of familial or spousal relationship
  • Emotional distress
  • Funeral expenses in cases of wrongful death

Though criminal sanctions for drunk drivers often involve the payment of financial restitution to victims and their families, the dollar amounts are routinely insufficient to provide full compensation for the losses such conduct produced. Restitution payments in the criminal realm that are designed to compensate for specific losses may preclude the same sort of recovery in the civil arena, so it is important for victims to secure the assistance of a car accident attorney who understands how to maximize the resources available in the aftermath of such a tragedy and can effectively negotiate with a driver’s insurance carrier when his or her negligence or criminal acts result in harm to a passenger.
